Become a Coach Terms and Conditions Agreement

Become a Coach Online Course Policy - To access the online Become a Coach Online Course, you must attest that you have read and agree to the terms and conditions contained in this Become a Coach Terms and Conditions Agreement. The term “course” includes the Online Course Web pages, courses and all associated materials. Read this Become a Coach Course Terms and Conditions Agreement carefully.

Effective Date - This Agreement shall start upon registration by the Participant in the Program and shall be enforceable between the parties starting on that registration date.

Limited License – By purchasing the Program, the Participant is granted a single-use, non-exclusive, non-transferable, revocable license to access, view and use the Program. The Participant is granted the right to download, store and print single copies of items comprising the Program. All ownership rights in the intellectual property related to the Program remain with the Provider, Financial Coach Jess, and the Participant may not use or reproduce any of the content in any manner, without the express written consent of Financial Coach Jess. Any violation of the copyright or trademark rights of the Provider shall result in immediate termination of access to the Program without refund. 

Use of Online Course Materials - All courses and materials, along with references used in or related to the courses, are the property of Financial Coach Jess, and may only be used in the manner detailed in this Become a Coach Course Terms and Conditions Agreement. Permission to use the material in any other way must be obtained in writing from Financial Coach Jess. These materials are for the sole use of individuals registered for the e-course or others as approved by Financial Coach Jess. As an online course registrant, you may view and read all materials that are part of the course material. You may also print any or all screen and pdf file pages for your personal use in taking the course, but you may not share, communicate, publish or in any manner distribute to other parties the course, login and password, readings, references, links or any other materials. The terms and conditions regarding use of materials apply upon registration for the course, while you are taking the course, and upon and after completing, withdrawing from or terminating the course.

Trademarks and logos displayed on the Website, in courses or on material are trademarks belonging to the Provider, Financial Coach Jess, unless otherwise indicated. Any use including framing. Meta tags, or other text utilizing trademarks or other trademarks displayed is strictly prohibited without Provider’s written permission.

License to Us- Submitting to us, posting, or commenting with any photo, image, video, or text or any other submission for use on our website or online platform grants us an unlimited, royalty free, perpetual, irrevocable unrestricted, non-exclusive license to use, copy modify, distribute, transmit, sell, create derivative words from or display such contributions in whole or in part, in any manner or medium now known or developed in the future. This right includes granting proprietary or intellectual property rights under any relevant jurisdiction without permission or compensation by Provider to you.

Fees – The fees for online courses and any membership programs shall be as set out in the Program website. The fees charged by the Provider shall be subject to all applicable taxes as required by the taxing authorities in the jurisdiction of Provider. 

Credit Card Authorization – By purchasing a Program or Course with a payment plan or recurring membership fees, the Participant hereby authorizes the Provider to charge their credit card or other payment cards automatically for any first time or ongoing membership fees or payments owing as determined by the provisions of this Agreement.

Passwords - Any passwords and user IDs used for the Program are for the Participant’s individual use only. The Participant is responsible for the security of their password and user ID (if any) and is responsible for all activities that occur under their user ID and password. The Participant agrees to notify the Provider immediately of any unauthorized use of their password or account or any other breach of security. The Provider will be entitled to monitor passwords and user IDs and, at its discretion, require Providers to change passwords. The Participant further agrees that the Provider will not be responsible for the unauthorized use of a Participant profile by any other person and is under no obligation to confirm the actual identity of any password or user ID. The Provider cannot and will not be liable for any loss or damage arising from a Participant’s failure to comply with these provisions.

Refunds for Courses - You may withdraw from a course at any time. However, once you are registered and have logged in to the course, you will not receive a refund for any reason.

Course Management System Access - You agree that you will not use any robot, spider or other device, process or means to access Financial Coach Jess’ courses. Nor shall you use any process to monitor or copy our Web pages or the content contained thereon or for any other unauthorized purpose without our prior expressed written permission. You agree that you will not compromise or circumvent the security controls of the courses or otherwise gain unauthorized access to courses. You agree that you will not use any device, software or routine that interferes with the proper working of Financial Coach Jess’ courses nor shall you attempt to interfere with the proper working of the courses. You agree that you will not take any action that imposes an unreasonable or disproportionately large load on our infrastructure. You agree that you will not copy, reproduce, alter, modify, create derivative works or publicly display any content from the courses without the prior expressed written permission of Financial Coach Jess.

DISCLAIMER OF WARRANTIES - The Program is provided “as is” and “as available”, without warranty or condition of any kind, either express or implied. The Provider expressly disclaims all warranties and conditions, including any statutory or implied warranties or conditions of merchantability, fitness for a particular purpose, title, quiet enjoyment or non-infringement in respect to the Program, to the fullest extent permissible under applicable law. While the Provider intends to provide content that is correct, accurate and timely, no representations or warranties are made regarding the Program or online course including, without limitation, the Providers provide no representation or warranty that (i) the Program will be accurate, reliable, complete, current, timely or suitable for any particular purpose, (ii) that the operation of the course hosting platform will be uninterrupted or error-free, (iii) that defects or errors in the Program will be corrected, (iv) that the course hosting platform will be free from viruses, malware, worms or other harmful components, and (v) that communications to or from the course hosting platform will be secure and/or not intercepted. You acknowledge and agree that you are using the Program at your own risk and liability.

Legal and Financial Disclaimer – This Website, courses, and its contents is not a substitute for legal, tax, accounting, medical, mental health, or similar professional advice or therapy. You agree that we are not responsible for your well-being, earnings, success, or failure of business or financial decisions, or any result of any kind.

Indemnification -You agree to indemnify, defend and hold harmless Financial Coach Jess and their respective shareholders, members, managers, officers, directors, employees, agents, and licensors from and against any and all claims, causes of action, demands, liabilities, damages, losses, expenses (including reasonable attorneys’ fees and costs) and assessments (including tax assessments) arising out of or in any way related to: (a) your access to or use of the Website, any Account created on the website, any newsletter or other content or any other products and services available at or through the Website; (b) any product, content (including any newsletter), information, materials or services available at or through the Website; (c) your breach or purported or threatened breach of any provision of this Agreement or any warranty you provide herein, or (d) your violation or purported or threatened violation of any applicable laws, rules, regulations or rights. You agree to cooperate fully with Financial Coach Jess in asserting any available defenses in connection with a claim subject to indemnification by you under this Agreement.

Governing Law - This Agreement and all matters relating to the meaning, validity or enforceability thereof and the performance of services hereunder shall be governed by the laws of the State of Missouri.

Model Release - The Client hereby assigns the Financial Coach Jess the irrevocable and unrestricted right to use and publish photographs or video of the Client testimonials or in which the Client may be included, for editorial, trade, advertising, educational and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same without restriction. The Client releases all claim to profits that may arise from use of images and video.

Customer Service Requests – If you have questions or comments or need to provide notice of any kind to Financial Coach Jess regarding Programs including cancellations of your Program, please e-mail us at [email protected].

Entire Agreement - This is the entire agreement between the Participant and the Provider, Financial Coach Jess relating to your access and use of the Program and the content therein.

All Sales Final

Any customer who purchases a course or coaching program from Financial Coach Jess LLC agrees that their purchase is “All Sales Final.” This means that there are no refund or transfers. The purchaser agrees upon checkout that no refund will be provided, and no transfers will be granted.

There is no refund given for any customer who does not utilize their coaching program or course. The online coaching or course may not be transferred to another customer.
